On November 4, 2014, California voters passed Proposition 47, now known as Penal Code section 1170.18.  This law provides for felony convictions for simple drug possession and certain minor thefts (less than $950) to be reduced to misdemeanors.

If you have been convicted in Marin County of one of the following felony offenses, you may qualify for a reduction to a misdemeanor under this new law:

  • Commercial Burglary (Penal Code section 459)
  • Forgery (Penal Code section 470)
  • Bad Check (Penal Code section 476)
  • Grand Theft (Penal Code section 487)
  • Possession of Stolen Property (Penal Code section 496)
  • Petty Theft with priors (Penal Code section 666)
  • Possession of a Controlled Substance: heroin or cocaine (Health and Safety Code section 11350)
  • Possession of a Controlled Substance:  methamphetamine, ecstasy, mushrooms, pcp, etc. (Health and Safety Code section 11377)
  • Possession of concentrated cannabis (hashish) (Health and Safety Code section 11357(a)
