Charges Filed Against San Rafael Police Officers

District Attorney’s Office concludes review of June 2022 use of force incident

San Rafael, CA – Marin County District Attorney Lori E. Frugoli has announced her decision to file charges against two San Rafael Police officers who were involved in an arrest on July 27, 2022, that resulted in the use of force.

After a careful, comprehensive review of the evidence, the Marin County District Attorney’s Office has found sufficient evidence to pursue criminal charges against Officer Brandon Nail and former Officer Daisy Mazariegos.

The charges filed June 29 in Marin County Superior Court include Assault by an Officer Under Color of Authority, a violation of California Penal Code 149; and False Statements in a Crime Report, a violation of California Penal Code 118.1.

“After a thorough review of the evidence, which included body-worn camera footage, eyewitness accounts, medical records, and reports from the San Rafael Police Department, my office has concluded there is sufficient evidence to prove these charges beyond a reasonable doubt,” Frugoli said.

The defendants are presumed innocent unless found guilty by a court of law. They are scheduled to appear in Marin County Superior Court on August 11 at 9:00 a.m.

“The San Rafael Police Department has a well-earned reputation for providing outstanding service to the community and keeping it safe. This decision is not a reflection on the San Rafael Police Department in general or any other law enforcement agency. It is about holding two individual officers accountable for their unlawful conduct on a single day that was inconsistent with the department’s standards for professionalism.”
