Project Description

The applicant is requesting Design Review approval to construct two attached decks on a developed lot located in an unincorporated area of Mill Valley. The 424 square feet of proposed development that would result from this project would not increase the floor area ratio of the 7,350-square-foot lot. The first deck, proposed for the "Top Floor" of the residence as identified in the project plans, would be 270 square feet in size, reach a maximum height of 29 feet above surrounding grade, and maintain the following minimum setbacks from its exterior: 21 feet, 10 inches to the eastern property line and 17 feet, 4 inches to the southern property line. The minimum setbacks to the northern and western property lines for the Top Floor Deck cannot be determined from the submitted site plan. The second deck, proposed for the "Bottom Floor" of the residence as identified in the project plans, would be 154 square feet in size and appear to reach a maximum height of 19 feet, 1 inch above the surrounding grade. It would also maintain a minimum setback of 17 feet, 4 inches from its exterior to the southern property line. The minimum setbacks to the northern, eastern, and western property lines for the Bottom Floor Deck cannot be determined from the submitted site plan. 

Various improvements would also be entailed in the proposed development. These improvements involve the alteration of the structure's fenestration to facilitate interior layout changes and the installation of the proposed decks.

Design Review approval is required pursuant to Marin County Code Section 22.42.020(A) because the project proposes decks within a Planned zoning district that exceed a maximum height of five feet above grade (excluding hand railings and other safety features) and, as such, cannot be exempt from the requirement to obtain Design Review approval.
