APPROPRIATIONS LIMIT INCREASE

Article XIIIB of the California Constitution restricts governmental spending by setting an annual appropriations (spending) limit, which may be changed by voters.

This measure, if approved by a majority of those voting thereon, would establish the appropriations limit for the Stinson Beach County Water District at two million ninety-five thousand one hundred seventy-seven dollars ($2,095,177.00) for fiscal year 2018-2019. The limit of two million ninety-five thousand one hundred seventy-seven dollars ($2,095,177.00) would also be used to determine the limits of fiscal years 2019-2020 through 2021-2022.

This measure was placed on the ballot by the Board of Directors of the Stinson Beach County Water District.

ARGUMENT IN FAVOR OF MEASURE H

We urge a YES vote on this measure. The measure Will Not Increase Your Taxes. It will allow the Stinson Beach County Water District to make full use of the property tax revenue it already receives.

An amendment to the State Constitution in 1979 imposed a limit on expenditures of most local government agencies, including the District. The Constitution allows local agency voters to approve periodic increases in the limit. Stinson Beach voters have approved such increases in the past, most recently in 2014. Your Board of Directors is asking that the increased limit be continued for an additional four years.

If the measure is approved, the Water District will be able to retain its full pro rata share of property taxes collected by Marin County. Without this measure, tax revenues over the appropriations limit must be refunded to the State of California. The lost tax revenue would then have to be made up by an increase in local water rates.

  • Passage of this measure will not increase your taxes or other costs. It will keep the Water District’s share of property tax revenue “at home,” in our community
  • Passage of this measure will allow the District to maintain existing service levels without increasing water rates to make up for lost tax revenue.

We want to provide you high quality service at the lowest possible rates and consider this measure necessary to do so.

STINSON BEACH COUNTY WATER DISTRICT
RESOLUTION NO. GB-2018-02

A RESOLUTION CALLING AN ELECTION FOR THE PURPOSE OF SUBMITTING TO THE QUALIFIED ELECTORS OF THE DISTRICT THE QUESTION OF ESTABLISHING THE DISTRICT’S APPROPRIATIONS LIMIT UNDER ARTICLE XIIIB OF THE CALIFORNIA CONSTITUTION, FIXING THE DATE OF SAID ELECTION, REQUESTING THE CONSOLIDATION OF SAID ELECTION AND REQUESTING THE SERVICES OF THE COUNTY CLERK

WHEREAS, Article XIIIB of the California Constitution provides that the appropriations limit otherwise applicable to a governmental entity may be changed by the electors of such entity, subject to and in conformity with constitutional and statutory voting requirements; and

WHEREAS, the Board of Directors believes that it would be in the best interests of the residents of the Stinson Beach County Water District (the “District”) for the appropriations limit for Fiscal Year 2018-2019 to be established by the voters of the District and for the appropriations limit for the ensuing three fiscal years to be determined accordingly; and

WHEREAS, a statewide election will be held on June 5, 2018.

NOW, THEREFORE, BE IT RESOLVED by the Board of Directors of the Stinson Beach County Water District as follows:

Section 1. An election (the “election”) is hereby ordered and called and will be held in the District on Tuesday, June 5, 2018, at which election the following issue shall be submitted to all persons possessing all requirements of electors under the general election laws of the State of California and who are duly qualified electors residing within the District:

“Shall the appropriations limit of the Stinson Beach County Water District for Fiscal Year 2018-2019 be established at $2,095,177 and should the limit for that Fiscal Year (i.e., $2,095,177) be used to determine the limits for Fiscal Years 2019-2020 through 2021-2022?”

The $1,636,142 appropriations limit set by the Board of Directors on July 15, 2017 x 1.25 (same factor used in 2014) = $2,045,177 + $50,000 “Prudent Cushion” as used in 2014 = $2,095,177.

Section 2. The election shall be and is hereby consolidated, pursuant to law, with the statewide election to be held on June 5, 2018, and the election precincts, polling places and officers of election within the area of the District for the election shall be the same as those selected and designated by the County Clerk of Marin County for said statewide election. All proceedings incidental to and connected with the election shall be regulated and done in accordance with the provisions of law regulating the said statewide election.

Section 3. This resolution shall also constitute a request to the Board of Supervisors of Marin County and to the County Clerk to consolidate the election called by the Board of Directors with the statewide election on June 5, 2018.

Section 4. The County Clerk is authorized and directed, at District expense, to provide all necessary election services and to canvass the results of said election.
