The applicant requests Variance and Design Review approval to construct 111 square feet of additional floor area on a 2,220 square feet single family residence in unincorporated Mill Valley. The proposed development would have a total floor area of 2,331 square feet resulting in a floor area ratio of 30 percent on the 7,775 square-foot lot. The proposed development would reach a maximum height 39.11 feet above surrounding grade and would have the following setbacks: 5.5 feet from the eastern front property line; 10 feet from the northern side property line; 20 feet from the western rear property line. The proposed project also includes replacement of the car deck located in the right-of-way.
The project description has been expanded to include an unpermitted 180-square foot room addition located on the second level of the residence. The unpermitted addition extends over the southerly side property line and onto the adjacent property at 138 Homestead Boulevard. No permits for the room could be found on file in the Community Development Agency records. The applicant has voluntarily proposed to submit a Lot Line Adjustment application to rectify the encroachment of this unpermitted addition onto the adjacent property.
Design Review approval is required because the project exceeds the maximum height of 30 feet. Variance approval is required because the project exceeds a height of 35 feet, and because the addition encroaches into the required 25-foot front yard setback established by the R1 zoning district.
