The applicant requests Design Review approval to retroactively legalize unpermitted construction of a rooftop deck above an existing garage on a lot developed with a single-family residence and attached garage in Mill Valley. The rooftop deck measures approximately 25 feet wide by 22 feet long. The proposed rooftop deck would reach a maximum height of 16 feet, six inches above surrounding grade and the exterior walls would have the following setbacks: Five feet from the front (east) property line; five feet the side (south) property line; and over 50 feet from all other property lines.
Design Review approval is required pursuant to Marin County Code Section 22.42.020 because the rooftop deck exceeds the height of five feet above grade (excluding hand railings and other safety features) and has less than the required five feet side yard setback.
