The applicant is requesting Design Review approval to alter the height of a portion of the existing roof that is located in the rear yard setback on an existing single-family residence in Mill Valley. The roof would increase approximately one foot in height and is 15 feet at its tallest point. Design Review approval is required pursuant to Section 22.54.045.E of the Marin County Development Code where the height of a roof of a primary structure is being raised by not more than three feet in height above the existing roof. Discretionary entitlements are not required for the new 400 square foot detached garage and 828 square foot addition onto the existing single-family residence because these improvements would meet all the required development standards prescribed by the R1-B1 zoning district and would not exceed 3,500 square feet of floor area.
Design Review approval is required because the primary structure encroaches into the required rear year setback, but is exempt from Variance approval pursuant to Development Code section 22.54.045E.
