Project Description

The applicant requests Design Review approval to legalize an existing retaining wall and construct a new 778 square foot multi-level addition to an existing residence in Novato, CA. If approved through Design Review, the subject retaining wall would reach a maximum height of 6 feet, 9 inches above surrounding grade, and would have the following setbacks: 207 feet from the northeastern front property line, 42 feet, 6 inches from the southeastern side property line, 54 feet, 9 inches from the northwestern side property line, 19 feet from the more restrictive, private, open space access easement located in the rear yard, and more than 205 feet, 6 inches from the southwestern rear property line.

The 778 square feet of proposed development would result in a floor area ratio of 17 percent on the 43,124 square foot lot. The proposed addition would reach a maximum height of 26 feet above surrounding grade and the exterior walls would have the following setbacks: 57 feet, 5 inches from the northeastern front property line; 38 feet from the southeastern side property line; 110 feet, 11 inches from the northwestern side property line, 138 feet from the more restrictive, private, open space access easement in the rear yard, and more than 200 feet from the southwestern rear property line. Various site improvements would also be entailed in the proposed development, including an outdoor trellis, the conversion of existing space into an accessory dwelling unit, and legalizing the other existing retaining wall that conforms with Development Code standards.

Design Review approval is required pursuant to Marin County Code Section 22.42.025 because one of the unpermitted retaining walls is greater than 6 feet above grade and located in the rear yard setback. Design Review is also required because the proposed multi-story addition is greater than 750 square feet and does not qualify for a Design Review exemption.
