The applicant requests Design Review and Tree Removal Permit approval to construct a new 3-story 5,189 square foot residence and a 702 square-foot attached garage on a vacant lot in San Rafael. The new residence would result in a floor area ratio of 23.3 percent on the 22,199 square-foot lot. The proposed building would reach a maximum height of 34 feet 6 inches above surrounding grade. The garage is proposed to be located 10 feet 9 inches from the northern front property line and 8 feet 5 inches from the eastern side property line. The house is located 25 feet 5 inches from the northern property line, 8 feet 5 inches from the eastern side property line, 63 feet 5 inches from the eastern side property line, and 59 feet from the southern rear property line. Two trees classified as “protected” as per the Marin County Development Code, are proposed to be removed to accommodate construction of the residence and associated site improvements.
Design Review approval is required pursuant to Marin County Code Section 22.42.020 because the project will result in total floor area that is greater than 3,500 square feet. A Tree Removal Permit is required because more than one “protected” tree is proposed to be removed.
