The applicant is proposing to divide an 11.23 acre lot into six 1+ acre lots as shown on the “Atherton Court Tentative Map”. The overall average lot slope for the lot is approximately 21%. The proposed lot slopes of the individual proposed building envelopes range from 5.5% to 13%. The property is currently developed with a single-family residence. The remainder of the property is undeveloped; the northern portion of the property is moderately sloped and consists primarily of pasture area; the southern portion of the property is steeply sloped and is primarily wooded.
As shown on the Tentative Map, a new access drive would be constructed along the western edge of the long, narrow lot, which would culminate at a turnaround mid-way into the property. The new driveway would provide access to four of the newly proposed lots. An access easement is proposed to extend from the turn-around and run along the two remaining proposed lots (Lots 4 and 5). Water service is proposed to be provided by the North Marin Water District. Sanitary Service is proposed to be provided via the Novato Sanitary District; the property would need to be annexed into the District prior to installation of the system.
Five trees, classified as either “protected” or “heritage” per the Marin County Development Code, are proposed to be removed to accommodate construction of the access drive and creation of the building envelopes associated with the subdivision.
Pursuant to Section 22.80.030, the subdivision or dividing the land into two or more lots requires a Tentative Map for the proposed Land Division. A Tree Removal Permit is required because the project entails removal of more than one “protected” tree.
