Project Description

The Marin County Planning Division intends to propose to rezone Assessor’s Parcels number 188-120-36. The current zoning for the property is C-ARP-5 (Coastal, Agricultural Residential Planned; 5-acre minimum lot size) and C-APZ-60 (Coastal, Agricultural Production Zone; 60-acre minimum lot size). The portion of the property zoned C-ARP-5 proposed zoning will be C-APZ-60 (Coastal, Agricultural Production Zone; 60-acre minimum lot size). The current Marin Countywide Plan designation is C-AG1 (Coastal Agricultural, 1 unit/31-60 acres) and C-AG3 (Coastal Agricultural, 1 unit/1-9 acres). The proposed Marin Countywide Plan designation will be C-AG1 (Coastal Agricultural, 1 unit/31-60 acres) for the entire property. These changes would also require the approved Local Coastal Program designation to be updated. The portion of the property designated C-ARP-5 would be change to C-APZ-60.

Resolution No. 07-174, a Resolution Approving with Conditions the Osterweis Ranch Master Plan Waiver, Coastal Permit and Design Review Applications approved November 29, 2007 included a rezoning condition. Condition of approval 22 stated that the applicant/property owner understands and hereby agrees not to object to the Marin Community Development Agency’s desire to rezone portion of APN 188-120-36 that is under the C-ARP-5 zoning to a C-APZ-60 zoning. The rezoning of this 6.38-acre parcel to C-APZ brings the Osterweis Ranch project into compliance with the Marin County agricultural preservation polices.
