 Eviction moratorium extended through September 30, 2022 in unincorporated Marin

On Tuesday June 21, 2022, the Marin County Board of Supervisors adopted a Resolution to bar evictions of residential tenants for nonpayment of rent due to the on-going impact of the Public Health Emergency arising from COVID-19 from July 1 through September 30, 2022 (Board Packet). This Resolution applies only to renters in unincorporated Marin.

Other Marin jurisdictions have also adopted an eviction moratorium extension, including: Town of Fairfax (adopted 06/15/22), City of San Rafael (adopted 06/21/22), City of Larkspur (adopted 06/23/22), City of Novato (adopted 06/28/22), and Town of Corte Madera (adopted 08/16/22). 

The Resolution reestablishes the local eviction moratorium previously adopted by the Board that was superseded by the State Legislature adopting Assembly Bill 2179, Assembly Bill 3088 and Senate Bill 91, set to expire on June 30, 2022. See the panel below for more details.

 California Mortgage Relief Program

The California Mortgage Relief Program uses federal Homeowner Assistance Funds to help homeowners get caught up on past-due housing payments and property taxes. The program is absolutely free and the funds do not need to be repaid.

Marin County Eviction Moratorium

Overview

On June 21, 2022, the Marin County Board of Supervisors adopted a Resolution barring evictions of residential tenants for nonpayment of rent due to the on-going impact of the Public Health Emergency arising from COVID-19 from July 1 through September 30, 2022. This Resolution only applies to renters in the unincorporated areas of the County

The Resolution reestablishes the local eviction moratorium previously adopted by the Board that was superseded by the State Legislature adopting Assembly Bill 2179, Assembly Bill 3088 and Senate Bill 91, set to expire on June 30, 2022. The local Resolution applies to all renters experiencing financial hardship due to COVID-19, and provides a 90-day repayment period for any rent past-due.

If a landlord is attempting to evict a tenant for nonpayment of rent, they must first provide a 15-day notice which includes required noticing language, and a blank declaration of financial hardship form (EspañolTiếng Việtрусскийفارسی). Under this Resolution, “COVID-19 financial distress” is defined as:

  • Loss of income caused by the COVID-19 pandemic;
  • Increased out-of-pocket expenses directly related to performing essential work during the COVID-19 pandemic;
  • Increased expenses directly related to health impacts of the COVID-19 pandemic;
  • Childcare responsibilities or responsibilities to care for an elderly, disabled, or sick family member directly related to the COVID-19 pandemic that limit my ability to earn income;
  • Increased costs for childcare or attending to an elderly, disabled, or sick family member directly related to the COVID-19 pandemic;
  • Other circumstances related to the COVID-19 pandemic that have reduced income or increased expenses.
