At no earlier than 10 a.m., the Board will conduct a hearing to consider a resolution changing the current fee for specified real estate instruments and amending the scope of real estate instruments subject to the fee from the District Attorney's Office. In 2004, a Real Estate Prosecution Trust Fund was established, consisting of recording fees paid at the time of recording specified real estate documents. Funds resulting from those fees enhance the capacity of law enforcement and prosecutors to deter, investigate and prosecute real estate fraud. In 2008, those fees were set at $3. In 2012, California Legislature declared the $3 fee as insufficient to adequately fund real estate fraud prosecutions. The proposed resolution suggests increasing the current recording fee from $3 to $10.
