Appeal of Planning Commission Decision

Board of Supervisors

Meeting Date: 8/2/2016

The Board will conduct a hearing on the Thompson Development Inc. appeal of the Planning Commission’s denial of the 766 Bay Road Design Review and Tree Removal Permit applications. The applicant proposes the construction of a new four-story, 26.75 foot high, 2,096 square foot single-family residence with an attached 479 square foot garage on a 7,356 square foot lot in unincorporated Tam Valley. The Planning Commission denied the project in January 2015 and considered a modified project on July 27, 2015. Planning staff recommended approval of the revised project after finding it consistent with the Countywide Plan, the Marin County Development Code, the Tamalpais Area Community Plan, and Single-Family Design Guidelines. However the Planning Commission voted 4-2 to deny the project a second time, citing inconsistency with the Tamalpais Area Community Plan on bulk/massing and site grading. This item was continued to a later date in November 2015 and May 2016.

The Board adopted a resolution approving a revised project.
